But they never even consider the next morning. The truth is that you certainly can be arrested on impaired driving charges the next day. Why would this happen?
Your BAC may not have decreased as much as you think
The problem is often just that it takes time for your blood alcohol concentration (BAC) to go down. Every hour, it is only going to drop by about 0.015%. So it would take four hours to go down from 0.06% or six hours to go back down from 0.09%.
As such, it really depends on how high your BAC was the night before and how long you slept. If you were right at the limit and then you slept for eight or nine hours, you would probably be fine. But if you were well over the legal limit and you only slept for a few hours before you had to get up and go to work, you could still be under the influence.
